These Terms of Service (“Terms”) govern your access to and use of the Phoenux Design website at phoenux.design and related online materials we publish. By using the site, you agree to these Terms. Project work is governed by a separate proposal, statement of work, or master services agreement between you and Phoenux Design.
Who we are
Phoenux Design is a product design studio. Website inquiries go to hello@phoenux.design. Nothing on the marketing site creates a client engagement until we both sign a written agreement or accept a written statement of work.
Using the website
You may use this website for lawful purposes only — to learn about our studio, review portfolio and service information, and contact us. You may not attempt to disrupt, scrape at abusive scale, reverse engineer, or overload the site or its infrastructure, or use the site to send spam or unlawful content.
No professional advice on the site alone
Content on the site (including service descriptions, rates philosophy, notes, and case studies) is general information about our studio. It is not legal, financial, or medical advice, and it is not a guarantee of outcomes for your product. Case study metrics describe past work for named clients under the conditions of those engagements; your results will vary.
Intellectual property
Site content — including text, visuals, brand marks, and case study materials — is owned by Phoenux Design or our clients and may not be copied, scraped for model training, or republished without permission, except for ordinary browser caching and fair dealing / fair use as applicable. Client work shown in the portfolio remains subject to each client’s rights and any NDAs.
Inquiries and estimates
Submitting a contact form or booking a call does not obligate either party. Estimates we share are based on the brief and assumptions we state; scope changes can change price and timeline. Public ranges on the Rates page are illustrative bands, not fixed quotes.
Third-party links and tools
The site may link to third-party sites (for example client products, Cal.com booking, or social profiles). We are not responsible for their content or privacy practices. Embedded or linked tools are subject to their own terms.
Disclaimer of warranties
The website is provided “as is” and “as available.” To the fullest extent permitted by law, Phoenux Design disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the site. We do not warrant that the site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Phoenux Design and its people are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website. Our aggregate liability relating to the website itself is limited to one hundred US dollars (USD $100) or the minimum amount required by applicable law. This limit does not replace liability terms in a signed client agreement for project work.
Indemnification
You agree to indemnify and hold harmless Phoenux Design from claims arising out of your misuse of the website or your violation of these Terms, to the extent permitted by law.
Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Courts in Toronto, Ontario shall have exclusive jurisdiction over disputes arising from website use, except where applicable law requires otherwise.
Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the site after changes constitutes acceptance of the updated Terms.
